As you might guess, Epic Games again asked the court to "force" Apple to return Fortnite Battle Royale back to the App Store. Interestingly, the company has already asked the court to ban the removal of Fortnite from the App Store and the removal or deactivation of an already installed Fortnite app from iOS devices. However, then the court refused to grant this request, as the company had to understand what it was doing, violating the agreement with Apple.
Apple commented on this request with the statement that the company itself deliberately and purposefully harmed players and developers and is now asking the court to intervene and correct the situation, which, by and large, itself created.
For the first time, Epic Games insisted that the removal of Fortnite was damaging the company's business reputation, but this time the lawyers decided to use a new argument - causing "irreparable damage." In a new 182-page lawsuit, the company noted that daily active users on the iOS platform have dropped 60% since Fortnite was removed from the store.
For battle royale, the iOS platform is the largest - 116 million registered users out of 350 million total audiences, that is, almost a third. At the same time, 63% of Fortnite players on iOS play the game exclusively on this mobile platform, without using a PC and console, respectively, their loss cannot be compensated for by other devices.
Epic Games fears that Fortnite's continued absence from iOS could lead to iOS users losing interest in the game and never returning to it, even if it is subsequently returned to the App Store. The court has not yet responded to this request.
As a reminder, Apple recently removed the Epic Games account from the App Store, so now the developer will not be able to download updates and new games to the store. Fortnite kicked off a new season in late August, but it's not available for iOS and Mac due to a conflict between Epic Games and Apple.
